Marketplace terms

These terms apply to the Plumely Marketplace — the part of Plumely where businesses post briefs and creators bid on them. They are in addition to the general Plumely Terms of Service, which continue to apply to the editor and to your account. If the two conflict on a marketplace matter, these terms govern. The most important thing in this document is section 2, and you should read it before you rely on the marketplace for anything.
1. What the marketplace is
The marketplace is an introduction service. Plumely publishes briefs submitted by users, allows other users to submit bids, and provides messaging and optional contact-sharing between them.
Plumely is not a party to any agreement you reach with another user. Plumely is not your employer, your employee, your agent, your broker, or your representative, and does not supply the video production services described in any brief. Any contract for work is between the two users, on whatever terms they agree.
2. No payments, no escrow, no recovery
Plumely does not hold, process, transmit, escrow or insure any payment between users. All consideration is arranged and paid directly between the users concerned, off the platform, by whatever method they choose.
It follows that Plumely cannot reverse, refund, recover, guarantee or compensate for any payment, and cannot adjudicate a dispute about one. If you are defrauded by another user, Plumely can remove that user's account and record the report — it cannot return your money.
Plumely takes no commission or success fee on any transaction between users. Charges are for posting briefs and placing bids only, are payable to Plumely regardless of the outcome of any engagement, and are not refundable because a deal did not proceed.
3. What verification means — and what it does not
Plumely displays verification facts on user profiles. Each states what was checked and the date on which it was checked. Their meanings are limited to the following, and nothing broader should be inferred from them.
"Domain verified" means that, on the stated date, a DNS record requested by Plumely was present on that domain — that is, that someone with control of the domain's DNS acted on our instruction.
"Channel verified" means that, on the stated date, the holder of the Google account which owns that YouTube channel authorised Plumely to read the channel's public details.
"Linked profile" means that, on the stated date, the stated page contained a link back to the user's Plumely profile, indicating common control of both.
These checks do not verify any person's or company's legal identity, registration, address, creditworthiness, solvency, ability or intention to pay, professional competence, the quality or originality of any work displayed, or the absence of fraudulent intent. Plumely does not carry out identity-document checks, background checks, credit checks, or checks against public business registries. Where a user supplies a registration number such as a GSTIN, Plumely checks only that its format is valid and displays it as supplied; it is not confirmed with the issuing authority.
No verification fact, badge, tier or trust indicator is an endorsement, recommendation, guarantee or certification by Plumely of any user, and must not be relied upon as one. You remain responsible for your own due diligence before entering into any agreement or making any payment.
4. Your responsibilities
- Carrying out your own due diligence on anyone you deal with, and agreeing your own contract terms.
- The accuracy of everything you publish, including briefs, bids, portfolio links and profile claims.
- Holding the rights to any work you present as your own, and to anything you supply to another user.
- Your own tax position, including any GST, TDS or withholding obligations arising from an engagement. These are matters between you, the other user and the relevant authority; Plumely is not involved and issues no invoice for your engagement.
- Keeping your account credentials secure. Changing your account email revokes all of your verifications, which must then be re-proved.
5. Prohibited conduct
You must not use the marketplace to do any of the following. Each corresponds to a reason you can select when reporting another user.
- Requesting or requiring any payment, deposit, fee or purchase from a creator as a condition of being engaged. No brief on Plumely may require a creator to pay anyone.
- Failing to pay for work delivered in accordance with an agreement.
- Failing to deliver work that has been paid for.
- Impersonating any person, business or brand, or using a display name that implies an affiliation you have not verified.
- Presenting work you did not produce, or do not hold the rights to, as your own.
- Posting a brief whose purpose is to obtain unpaid work, or misrepresenting a deliverable as a test.
- Requesting or supplying credentials, OTPs, PINs, or payment through links sent in messages.
- Creating additional accounts to evade a restriction, to inflate a reputation, or to manufacture reviews or engagement history.
- Harvesting, scraping or bulk-collecting contact details or profile data, whether manually or automatically.
- Anything unlawful, or any content that is fraudulent, harassing, discriminatory, obscene, or infringing.
6. Reports, removal and suspension
Plumely may restrict, suspend or remove any brief, bid, message, profile or account, at its discretion and without prior notice, where it considers these terms to have been breached or where doing so protects other users. Plumely is under no obligation to restore removed content.
Where an account is removed for a breach, Plumely may retain a record of the verified artifacts associated with it — for example a hash of a verified domain or channel identifier — and may refuse to verify those artifacts again on any future account. This is retained for the purpose of preventing repeat harm.
Reports are reviewed by a person. Where a report is upheld, a factual record of it may be displayed on the relevant profile.
7. Content you publish
You retain ownership of what you post. You grant Plumely a non-exclusive, worldwide, royalty-free licence to host, display, reproduce and distribute it for the purpose of operating and promoting the marketplace — including displaying briefs and public profiles to search engines, which is how creators and clients find each other.
Public briefs and complete public profiles are indexable by search engines. Do not put anything in them you would not want publicly readable. Contact details are held separately and are never included in public profile data.
8. Disclaimer and limitation of liability
The marketplace is provided "as is". To the fullest extent permitted by law, Plumely disclaims all warranties in relation to it, including as to the accuracy of user content, the conduct of users, and the outcome of any engagement.
To the fullest extent permitted by law, Plumely is not liable for any loss or damage arising out of your dealings with another user, including non-payment, non-delivery, defective or infringing work, fraud, or any loss arising from payments made off the platform. This is in addition to, and does not limit, the disclaimers and limitations in the general Plumely Terms of Service.
Nothing in these terms excludes any liability that cannot lawfully be excluded.
9. Eligibility
You must be at least 18 years old to use the marketplace. This is a stricter requirement than for the Plumely editor, and it applies to posting briefs, placing bids, messaging, and holding a marketplace profile.
10. Changes
Plumely may amend these terms. Material changes will be notified on this page with an updated date, and continued use of the marketplace after that date constitutes acceptance.
11. Grievance officer and complaints
If you have a complaint about content on the marketplace or about another user's conduct, you can report it in-product from the relevant brief, profile or thread, or contact the Grievance Officer directly.

Complaints will be acknowledged within 24 hours of receipt and resolved within 15 days, in accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
12. Governing law
These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute arising from them.
